This Consumer Health Data Privacy Policy explains how Boost Claims (“we,” “us,” or “our”) collects, uses, and shares consumer health data when you use this website and complete our questionnaire (the “Services”). It supplements our Privacy Policy and applies in addition to it. Where this policy conflicts with the Privacy Policy with respect to consumer health data, this policy controls.
Boost Claims is not a law firm and does not provide legal advice. We are a paid advertising and lead-generation service that connects people who may have been injured with independent attorneys or legal service providers.
1. What “Consumer Health Data” Means Here
“Consumer health data” is personal information that is linked or reasonably capable of being linked to you and that identifies your past, present, or future health status. In our questionnaire this includes the answers you give about whether you were injured in an accident, the type of accident, when it occurred, and whether you received or sought medical treatment.
2. How We Collect It
We collect this information directly from you when you choose to answer the questions in our questionnaire. We do not ask you for diagnoses, medical records, or other detailed medical history, and we ask you not to provide them.
3. Why We Use It
- To determine whether you may have a potential injury claim;
- To connect you with one or more independent attorneys or legal service providers who may be able to assist you; and
- To contact you about your inquiry and to operate the Services.
We do not use your consumer health data for targeted advertising, and we do not use it to deny you services.
4. How and With Whom We Share It
With your consent, we share the information you submit with one or more independent attorneys, law firms, or legal service providers so they may contact you about your potential claim, and with service providers who help us operate the Services (such as hosting and communications providers). Because our service is funded by the attorneys and law firms we connect you with, this sharing may be considered a “sale” or “sharing” of consumer health data under applicable law, and we will only do so with your consent.
We do not sell or share your consumer health data with any third party for that party’s own independent marketing purposes.
5. Your Consent and Right to Withdraw
Before you answer any health-related question, we ask for your affirmative, opt-in consent to collect and share your consumer health data as described above. Providing this consent is your choice. You may withdraw your consent at any time by contacting us at privacy@boostclaims.com or by using our Do Not Sell or Share My Personal Information page. Withdrawing consent will not affect the lawfulness of any processing that occurred before you withdrew it.
6. Your Rights
You have the right to:
- Confirm and access the consumer health data we have collected about you;
- Delete your consumer health data, subject to legal exceptions (for example, records we must retain as proof of consent);
- Withdraw your consent and opt out of the collection and sharing of your consumer health data; and
- Appeal a decision we make about your request. If we deny your request, you may appeal by replying to our response, and you may also contact the Nevada Attorney General.
To exercise any of these rights, contact us at privacy@boostclaims.com. We will respond within the timeframe required by applicable law. We will not discriminate against you for exercising any of these rights.
7. No Geofencing
We do not use a geofence to establish a virtual boundary around any health-care facility, and we do not use location information to identify or track consumers seeking health-care services or to send you health-related advertisements.
8. Data Security and Retention
We use reasonable administrative, technical, and physical safeguards to protect your information, though no method of transmission or storage is completely secure. We retain consumer health data only as long as needed for the purposes described above and to comply with our legal obligations, including retaining proof of your consent.
9. Changes to This Policy
We may update this policy from time to time. When we do, we will revise the “Last updated” date above.
